    educational content, appointment booking systems, and all services offered by SMUDRA (collectively, the
    “Services”).
    By accessing or using our Services, booking appointments, participating in any research or treatment programs, or
    interacting with our content, you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to
    be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use
    of our Services.

    SMUDRA is a national patient advocacy and research association dedicated to advancing the understanding,
    awareness, education, and holistic management of sinusitis, migraine, and related untreated diseases. SMUDRA
    also operates specialized Ayurvedic and integrative clinics offering diagnostic, therapeutic, and wellness services.
    Our mission is to support individuals and families affected by these conditions through research, education,
    advocacy, and evidence-informed care.
  3. Eligibility and Account Responsibility
    You must be at least 18 years of age to use our Services or book appointments independently. Minors may access
    Services only under the supervision and with the consent of a parent or legal guardian. You are responsible for
    maintaining the confidentiality of any login credentials and for all activities that occur under your account. You agree
    to provide accurate, current, and complete information when registering, booking appointments, or communicating
    with us.

    Appointment bookings are subject to availability and confirmation. SMUDRA reserves the right to reschedule or
    cancel appointments due to unforeseen circumstances, including clinician unavailability or operational requirements.
    You agree to provide accurate medical history and relevant information during consultations. Failure to disclose
    material health information may affect the safety and effectiveness of any recommended care.
    Treatment protocols are individualized. You are expected to follow the prescribed regimen, attend follow-up visits as
    advised, and inform the treating practitioner of any adverse reactions or changes in condition promptly.
  6. Research, Education and Advocacy
    As a research association, SMUDRA may invite users to participate in observational studies, surveys, clinical
    research, or educational programs. Participation is voluntary. Informed consent will be obtained where required.
    Data collected for research purposes will be handled in accordance with applicable laws and our Privacy Policy.

  1. Payments, Fees and Refunds
    Fees for consultations, treatments, packages, and other paid services will be clearly communicated prior to booking
    or commencement of service. Payment is due as per the terms specified at the time of booking or as stated on
    invoices. SMUDRA accepts payment through the methods displayed on the website or at the clinic.
    Refund and cancellation policies will be communicated at the time of booking. Generally, cancellations made with
    reasonable advance notice may be eligible for rescheduling or partial refund at SMUDRA’s discretion. No-shows or
    late cancellations may result in forfeiture of fees. Package or course fees are typically non-refundable once
    treatment has commenced, except as required by applicable law.
  2. Privacy and Data Protection
    Your privacy is important to us. Collection, use, storage, and disclosure of personal and health-related information
    are governed by our Privacy Policy and applicable Indian data protection laws, including the Digital Personal Data
    Protection Act, 2023 (as amended). By using our Services, you consent to such processing. Health information

    and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but
    not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or
    inability to use) the Services, any treatment or advice provided, or any content on the website.
    The Services and all content are provided on an “as is” and “as available” basis without warranties of any kind,
    either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose,
    or non-infringement. SMUDRA does not warrant that the Services will be uninterrupted, error-free, or free of viruses
    or other harmful components.
    Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any
    other liability that cannot be excluded or limited under applicable Indian law.
  4. Indemnification
    You agree to indemnify, defend, and hold harmless SMUDRA and its officers, trustees, employees, agents, and
    affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees)
    arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or
    your violation of any rights of another party.

    SMUDRA reserves the right to modify these Terms at any time. Changes will be effective upon posting on the
    website with an updated “Last Updated” date. Your continued use of the Services after any such changes
    constitutes your acceptance of the new Terms. We may also modify, suspend, or discontinue any part of the
    Services at any time without prior notice.
  7. Termination
    SMUDRA may, at its sole discretion, suspend or terminate your access to the Services, without prior notice or
    liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will
    immediately cease. Provisions that by their nature should survive termination (including intellectual property,
    limitation of liability, and indemnification) shall survive.
  8. Governing Law and Dispute Resolution
    These Terms shall be governed by and construed in accordance with the laws of India. Subject to the dispute
    resolution clause below, courts in Jaipur, Rajasthan shall have exclusive jurisdiction over any disputes arising out of
    or relating to these Terms or the Services.
    In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first
    attempt to resolve the matter amicably through good-faith negotiations. If unresolved within 30 days, the dispute
    may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat
    of arbitration shall be Jaipur, Rajasthan. The language of arbitration shall be English. The decision of the
    arbitrator(s) shall be final and binding.
  9. Force Majeure
    SMUDRA shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or
    delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural
    disasters, pandemic, epidemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods,
    accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
  10. Severability and Entire Agreement

    If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction,
    such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification
    is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
    These Terms, together with our Privacy Policy and any other legal notices or agreements published by SMUDRA,
    constitute the entire agreement between you and SMUDRA concerning the Services and supersede all prior or
    contemporaneous communications and proposals.
